Mediation Attendance
As a successful mediation necessarily involves the presence and participation of all decision makers and involved parties, we encourage you to arrange to have the appropriate individuals attend the mediation.  All participants in the mediation will be required to sign an agreement which, among other things, maintains the confidentiality of the mediation.  A copy of our standard Confidentiality Agreement is available on this website.

Preparation For the Mediation
We request mediation briefs, no longer than five pages, which include the factual and legal issues you believe to be pivotal in your case as well as a statement of settlement positions and anything else you deem helpful to facilitate good faith settlement negotiations. Please submit briefs at least three business days prior to the scheduled mediation.  We encourage you to exchange briefs prior to the mediation.  Should your briefs contain confidential information, please provide this office with an unexpurgated version and exchange expurgated versions with opposing counsel.  We also suggest bringing to the mediation all discovery responses and any other demonstrative evidence you believe may assist the settlement process.  Finally, it is helpful to bring a Draft Release/Settlement agreement, either hard copy or a copy on floppy, compact disc or USB Device to facilitate consummation of a settlement (we can accommodate most Word and Word Perfect formats).
